Since Tuesday, July 1, 2016, it has become mandatory to declare the secondment of your employees on the SIPSI site in France. Any employer established outside of France who plans to provide a service on French territory must send before the start of his intervention in France a prior declaration of posting of its employees to the labor inspectorate at the place where the service is provided. This formality also concerns transport companies who must send a posting certificate adapted to their activity.

The posting of employees for the employer’s own account is now exempt from declaration formalities. At the end of the online declaration procedure, you will be able to print your declaration and download an acknowledgment of receipt to communicate to your partners. During the entire period of their secondment, employees benefit from certain provisions of French labor law, in particular with regard to minimum wages and working hours. Information relating to Luxembourg

When a company temporarily posts an employee in Luxembourg, his employment contract remains governed by the law of his country of origin. Nevertheless, there are certain national (Luxembourgish) rules, qualified as public order by the Labor Code, which apply. By virtue of the principle of favor, these national public order provisions only apply if they are more favorable for the employee than the foreign provisions. With regard to administrative sanctions, disregard of the provisions relating to the posting of employees is liable to an administrative fine of an amount between 1,000 and 5,000 euros per posted employee and between 2,000 and 10,000 euros in the event of a repeat offense committed in the period of 2 years from the date of notification of the first fine. The total amount of the fine cannot exceed 50,000 euros.
