What your subscription includes
Company representation
Representation of a transport or construction company posting workers to France (Decree No. 2016-418 of 7 April 2016, “Macron law”) before public authorities, customs, the gendarmerie and the courts.
Posting declarations
Prior posting declaration on the official portal, amendments, cancellations and, for construction, the professional ID card application.
GRAMTAX Helpdesk
Phone support in Lithuanian, Russian, English and French during inspections and in case of breakdown, accident or damage.
Obligations and penalties
Regulatory monitoring and advice in labour and transport law on the posting rules in force.
A1 form
Support to keep each worker's A1 form available at the place of posting.
What role, what responsibilities?
Throughout the posting period, the representative is the contact point for inspectors: labour inspectorate, police, tax, customs and social security bodies. They keep the mandatory documents available for them, on paper or in digital form.
The representative's liability does not replace the employer's for the employer's own obligations. The representative is named in the prior posting declaration, with their agreement.
Exceptions
Posting on own account and the activities listed in the Order of 4 June 2019 do not require a representative.
Posting declarations
Road drivers: IMI portal
Since 2 February 2022, the posting of road transport drivers is declared on the European IMI portal (Directive (EU) 2020/1057). The declaration must be made before the posting starts and updated if anything changes.
Other sectors: SIPSI
For construction and other services in France, the prior declaration is sent via the SIPSI portal to the labour inspectorate of the place of work. Beyond 12 months, an extension of up to 6 months must be requested before the deadline.
Construction ID card
Any employer whose workers carry out building or public works must apply for a professional ID card (carte BTP) for each worker, after the SIPSI declaration. For temporary agency workers, the user company applies.
Documents to keep
The employer or its representative must be able to present without delay, translated into French, the documents proving genuine activity in the country of establishment:
- the employment contract or an equivalent document showing where the worker was recruited;
- any document showing the law applicable to the contract with the client established in France;
- any document showing the number of contracts performed and the turnover in the country of establishment and in France;
- each worker's A1 form, and payslips when the posting lasts one month or more.
The A1 form
The A1 form certifies that the worker remains covered by the social security system of their home country. It is valid for 24 months and must be available at the place of posting. Without an A1, the client company may also face a penalty.
What the employer risks
The authorities may also suspend the service for up to one month. Obstructing a labour inspection is an offence punishable by one year's imprisonment and a €37,500 fine.
