We would like to share with you information relating to suspensions of refunds of excise duties (“TICPE”) in the following cases:

* The French customs department, responsible for the reimbursement of excise duties to foreign transport companies that consume diesel in France, informs us that on 19-10-2021 a decision was taken to ban certain Lithuanian fuel suppliers issue certificates of allocation of fuel cards to tractors and requested Lithuanian subsidiaries and other branches to immediately correct errors in the allocation of fuel cards in the internal system.

Deficiencies detected in the invoices of certain suppliers in LITHUANIA and in other countries which may lead to the loss of your right to reimbursement: if the fuel cards have indeed been issued to a transport company, and if these fuel cards were not allocated to a particular tractor, or if the fuel card has been allocated to several tractors at the same time (WHAT IS PROHIBITED), transport companies using these fuel cards will probably lose the right to reimbursement of excise duties on diesel consumed in France (“TICPE “). Before 19-10-2021, the French customs authorities authorized the issuance of attestation of attribution of fuel cards to tractors if the invoice did not contain the following information: plate number of the tractor which consumed the diesel in France.

The fuel card attribution certificate was used in order to certify these deficiencies in the fuel invoices, but after the observation of several shortcomings. The French customs department, with the agreement of certain fuel suppliers in FRANCE, prohibited from 19-10-2021 from issuing this type of certificate to certain subsidiaries in LITHUANIA or to other branches, and immediately requested that the errors be corrected. allocation of fuel cards in the internal system of fuel suppliers. In the near future, fuel suppliers have promised to correct these fuel card allocation failures unless the transport company notices and requests it.

How to determine if your fuel bill is incomplete and if you risk losing your right to reimbursement of excise duties (“TICPE”) in France in the future : your transport company receives twice per month the invoice for the purchase of diesel from your fuel supplier, if you see in the detailed invoice the fuel card number instead of the tractor number, your fuel card has probably not been allocated to the tractor and you will probably lose the right to refund excise duties on this diesel consumed in France.

SOLUTION IS SIMPLE: Make sure, and contact your diesel supplier as soon as possible and ask to rectify this and ask to mark in all itemized invoices only the tractor number instead of the fuel card number.

Liability for loss of the right to reimbursement of excise duties: the responsibility for the accuracy of the information lies with the carrier according to the opinion of the customs administration in France. If, at the request of the transport company previously formulated, the fuel supplier acted negligently in issuing the fuel card and did not register the allocation of the fuel card to a designated tractor, the liability is the responsibility of your service provider.

Recommendation : In order to preserve your right to refund excise duties on diesel consumed in France, contact your fuel supplier as soon as possible and make sure that if the errors persist, just correct the anomalies in your invoices and check whether in your invoice the tractor number is noted next to the consumption. The fuel card number must not be visible on the itemized invoice, this may lead to the loss of your rights to the reimbursement of excise duties on diesel consumed in France.
